The Site contains the Epic Fails Video Submission Form (“Form”), which facilitates the transmission of videos and personal information (collectively, “Content”) from users of the Site (“Users,” “you,” or “your” whether in uppercase, lowercase, or a combination) to Tally, a third-party online form builder that collects and stores such Content on behalf of Epic Fails (“we,” “us,” “our,” or “ourselves” whether in uppercase, lowercase, or a combination). Such transmission occurs once you click, tap, or otherwise activate the “Submit” button located at the bottom of the Form after, at minimum, completing the required fields in the Form, each denoted by an asterisk (*). Activating the "Submit" button constitutes your decision to submit your Content through the Form for our consideration.

As such, we bear responsibility neither for such practices nor for what may happen with or to your Content as a result or byproduct of such practices. This Privacy Policy (“Policy”), which is incorporated into and is subject to our Terms of Use and Video Submission Policy, applies only to what we do with your Content once Tally collects and stores such Content on our behalf. This Policy explains, among other things, the Content we collect, how we use Content, and the circumstances in which we disclose Content. By using the Site, you affirm and certify that you have read, understand, and agree to be bound by this Policy, along with our Terms of Use and Video Submission Policy.
Content We Collect
We reserve the right to collect all Content that you submit to us through the Form.
“Content” is composed of (1) videos, defined as any and all media you submit through the Form, including, without limitation, the recording and display of moving visual media and any name, image, likeness, caricature, visual effect, vocal or other sound, sound effect, music, voice, voice reproduction, or performance featured in such media, regardless of the tangible medium, broadcast medium, form, or format, and regardless of where produced; and (2) personal information, defined as information that can be used to personally identify you such as your full name and e-mail address.
By submitting Content through the Form, you are consenting to the collection, use, and disclosure of such Content as outlined by this Policy.
How We Use Content
If deemed worthy for publication by us, we post (1) above to our accounts on third-party social media networks such as Instagram, TikTok, Facebook, Twitter, and YouTube (collectively, “Social Networks”).

We reserve the right to retain your Content for the prevention of fraud, abuse, and unlawful activity; for the satisfaction of legal obligations; or when we otherwise reasonably believe that we have a legitimate reason to do so.

The Site may feature material from, or contain links to, third-party websites and services (collectively, “Third Parties”). We also work with Third Parties that perform website hosting, Form hosting, and other services for us.

Children Policy
We do not knowingly collect personal information from children under the age of 18. We encourage parents to supervise the online activity of children and ensure that no child under the age of 18 is providing us with personal information. Please send an e-mail to contact@epicfails.tv if there is any reason to believe a child under the age of 18 has provided personal information to us, so we can remove such information from our databases. If you are a child under the age of 18, you are not allowed to use the Site at any time or in any manner.
